Welcome to SWEAS UNLIMITED ("Agency," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website located at https://sweasunlimited.com/contact (the "Site") and the services we provide (the "Services"), including SMS/text messaging communications.
By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree, you may not use the Site or Services.
1. Services
We provide digital marketing and automation services, including but not limited to:
Paid advertising management (Meta Ads, Google Ads)
AI-powered communication tools, including AI receptionist and SMS-based systems
Our Services are provided primarily to businesses in the med spa, aesthetic clinic, and professional services industries ("Clients").
2. Client Responsibilities
As a Client, you agree to:
Provide accurate, complete, and current information during onboarding and throughout the service term
Provide timely access to required third-party accounts (e.g., Meta, Google Ads, analytics platforms)
Maintain compliance with all applicable laws, including advertising, consumer protection, and messaging regulations
Obtain all legally required consents from your end users before engaging SMS, AI, or automated communications
Be solely responsible for advertising spend paid directly to third-party platforms
3. Fees and Payment
Fees are defined in your individual Service Agreement and may include:
Setup Fee: One-time, non-refundable fee for initial configuration and onboarding
Monthly Retainer: Recurring fee for ongoing management and support
Advertising Spend: Paid directly by Client to advertising platforms; not collected or controlled by Agency
Failure to make timely payments may result in suspension or termination of Services.
4. SMS/Text Messaging Terms (A2P 10DLC Compliance)
Consent to Receive Messages
By providing a mobile phone number and opting in via a web form, written agreement, or other explicit method, you consent to receive SMS/text messages from SWEAS UNLIMITED. Messages may include:
Service-related notifications
Account, onboarding, or support communications
Operational or administrative updates
Message frequency may vary. Message and data rates may apply.
Opt-Out and Help
You may opt out of SMS communications at any time by replying STOP to any message. For help, reply HELP or contact us at [email protected].
No Marketing Data Sharing
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors solely to provide operational services (e.g., messaging platforms). SMS opt-in data and consent records will not be shared with any third parties.
5. Performance Guarantees
Any performance guarantee (e.g., minimum booked consultations) will be explicitly defined in a written Service Agreement.
Guarantees are contingent upon Client compliance, including:
Maintaining recommended ad spend
Not altering campaigns without authorization
Providing required access and timely cooperation
If conditions are met and targets are not achieved, Agency will continue providing management services at no additional retainer cost until the target is met, as specified in the Service Agreement. Setup fees remain non-refundable.
6. Term and Termination
The service term is defined in the Service Agreement. After the initial term, services typically continue on a month-to-month basis.
Either party may terminate with 30 days written notice during a month-to-month term
Agency may suspend or terminate Services immediately if Client breaches these Terms, applicable laws, or messaging regulations
7. Intellectual Property
Agency IP: All proprietary systems, workflows, AI models, strategies, and materials remain the exclusive property of SWEAS UNLIMITED
Client IP: Client retains ownership of pre-existing branding, content, and customer data
Ad Creatives: Creatives developed by Agency are licensed for use during the service term only, unless otherwise agreed in writing
8. Confidentiality
Both parties agree to maintain the confidentiality of all non-public business, technical, and financial information obtained during the relationship.
9. Limitation of Liability
Carrier Liability Disclaimer
Mobile carriers are not liable for delayed or undelivered messages. SWEAS UNLIMITED is not responsible for any failures, delays, or errors in SMS delivery caused by mobile carriers, network issues, third-party messaging platforms, or circumstances outside of our reasonable control.
To the maximum extent permitted by law, SWEAS UNLIMITED shall not be liable for indirect, incidental, consequential, or punitive damages, including lost profits or data.

Agency’s total liability for any claim arising from the Services shall not exceed the total fees paid by Client to Agency in the three (3) months preceding the claim.
10. Disclaimer
Services are provided on an "AS IS" and "AS AVAILABLE" basis. Agency disclaims all warranties, express or implied, including fitness for a particular purpose and uninterrupted availability.
No guarantee is made regarding specific outcomes beyond those expressly stated in a written Service Agreement.
11. Governing Law
These Terms are governed by the laws of the State of Ilinois, without regard to conflict of law principles.
12. Changes to These Terms
We may modify these Terms at any time. Material changes will be posted with at least 30 days’ notice prior to becoming effective.
13. Privacy Policy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information, including SMS data.

Message frequency may vary and depends on the services the customer has requested.

These messages may include special offers, discounts and new product updates to customers who explicitly opted in to receive these messages by filling out a web form on our website or calendar. Message frequency is limited and promotional content is related to the services the customer has requested or shown interest in.
